I would imagine it falls under fair use as it was posted on a public internet site by the photographer. If the photographer ever wanted us to stop posting it, we would. I think we hotlink the picture most of the time so the photographer (if she's watching her web traffic) has almost certainly seen that it's been viewed by Threepwud roughly 10,000 times.

Also - the photographer is the one who tagged it as Black Julia Stiles, which is how we originally found it.

EDIT: realized you meant in terms of a whole site dedicated around that picture. Yes, we would probably get a cease and desist by multiple parties.
